North Fork Pool, Park and Recreation District Participation Waiver
Download Printable Waiver (Pool Only) PDFUse of the North Fork Pool, Park and Recreation District (the “District”) facilities and enrollment in its programs is subject to the rules and regulation promulgated by the District Staff.
District facilities may be closed to the public due to repair, maintenance, cleaning, or special events as determined by the District without refund of any pass portion to the members.
Pass & Membership Waiver & Refund Policy
REFUND POLICY: Pass refunds may be authorized for medical reasons, or employment transfer. Refunds will be prorated for part of the season already gone. Refunds may be requested by contacting the District Administrator.
A full refund will be given for programs or activities that are canceled by the District. If for any reason, a patron finds he/she cannot participate in a program or activity for which he/she is registered, a full refund will be issued if cancellation is made at least 48 hours in advance for lap swim, open swim, water aerobics and water Zumba®, and one week for swimming lessons. Participants should be informed that a refund may take up to four days to be issued. No refunds will be given for season pass purchases. WAIVER FOR PARTICIPATION: All exercise and participation are done at the risk of the participant, and the District is not liable for personal injury, theft, or loss of property. You assume full responsibility for yourself and your family members for any injuries, damages, or losses which may occur to you and hereby fully release and discharge the District and its employees and volunteers from any claims, demands, or damages resulting from your use of the facility and equipment.
Activity Waiver & Policy
WAIVER FOR PARTICIPATION
All exercise and participation are done at the risk of the participant, and the District is not liable for personal injury, theft, or loss of property. You assume full responsibility for yourself and your family members for any injuries, damages, or losses which may occur to you and hereby fully release and discharge the District and its employees and volunteers from any claims, demands, or damages resulting from your use of the facility and equipment.
COVID-19 Waiver
COVID-19 is an extremely contagious virus that spreads easily through person-to-person contact. Federal authorities and the State of Colorado recommend social distancing to prevent the spread of COVID-19. Contracting COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Use of the District facilities or enrollment in its programs could increase the risk of you contracting COVID-19. The District in no way warrants that COVID-19 infection will not occur through your use of its facility.
General Release and Waiver
By signing this agreement, I waive my right to bring any legal action now or at any time in the future to recover compensation or obtain any other remedy for any injury to myself or my property or for my death, however caused, arising out of my use of the District facilities and/or participation in the District activities. I further agree that I, my spouse, assignees, heirs, guardians, and legal representatives will not make any claim against, sue or attempt to attach the property of the District for any loss or damage resulting from my use of the District facilities and/or participation in the District activities. I am aware of the potential dangers incidental to recreational sports activity, that this is a release of liability, a waiver of my legal right to collect damages in the event of injury, death or property damage, and a contract between the District and me, and I sign it of my own free will.
I expressly agree that this release is intended to be as broad and inclusive as the State of Colorado will allow and that if any portion is held invalid, I agree that the balance shall, not withstanding, continue in full legal force and effect.
